1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and tropicirkan ("Company," "we," "us," or "our") regarding your access to and use of our website and services.
By accessing our website, making an inquiry, or booking our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services or website.
Please read these Terms carefully before proceeding with any booking.
2. Definitions
For purposes of these Terms:
- "Services" refers to all temple tour packages, cultural experiences, and related services offered by tropicirkan
- "Booking" means a confirmed reservation for our services
- "Participant" refers to any individual traveling as part of a booked tour
- "Force Majeure" means events beyond reasonable control, including natural disasters, war, terrorism, government action, or health emergencies
- "Website" refers to tropicirkan.live and all associated subdomains
3. Service Description
tropicirkan provides cultural heritage tours focusing on ancient Cambodian temple complexes. Our services include:
- Expert-guided temple tours with qualified historians
- Accommodation arrangements where specified
- Transportation as detailed in tour itineraries
- Meals as specified in individual tour packages
- Temple entrance fees and site access
Services are subject to availability and may be modified based on operational requirements, safety considerations, or factors beyond our control.
4. Eligibility and Capacity
To book our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete information
- Have authority to make bookings on behalf of all participants
Participants under 18 must be accompanied by a parent or legal guardian who accepts full responsibility for the minor's participation.
5. Booking Process
5.1 Inquiry and Quotation
Tour inquiries can be submitted through our website contact form, email, or phone. We will provide a detailed quotation including tour itinerary, pricing, inclusions, and exclusions.
5.2 Confirmation
A booking is confirmed upon:
- Receipt of completed booking form with all required information
- Payment of required deposit or full payment
- Issuance of booking confirmation by tropicirkan
5.3 Waiting List
If a tour is fully booked, we may offer placement on a waiting list. Waiting list positions do not constitute confirmed bookings.
6. Pricing and Payment
6.1 Pricing
All prices are quoted in Malaysian Ringgit (MYR) unless otherwise specified. Prices include items specifically listed in the tour itinerary. Prices do not include:
- International airfare to/from Cambodia
- Visa fees and travel documentation costs
- Travel insurance (strongly recommended)
- Personal expenses and gratuities
- Meals not specified in the itinerary
- Optional activities or excursions
6.2 Payment Terms
Payment schedule:
- 30% deposit required upon booking confirmation
- Balance due 45 days prior to tour departure
- Full payment required at booking for departures within 45 days
6.3 Payment Methods
We accept:
- Bank transfer to designated account
- Credit/debit card payments (processing fees may apply)
- Online payment platforms as specified
6.4 Price Changes
Prices are subject to change until booking is confirmed with deposit payment. After confirmation, prices are fixed except in cases of significant currency fluctuations, fuel surcharges, or government-imposed tax changes.
7. Cancellation and Refund Policy
7.1 Cancellation by Client
Cancellation fees apply as follows:
- More than 60 days before departure: 20% of total tour cost
- 45-60 days before departure: 40% of total tour cost
- 30-44 days before departure: 60% of total tour cost
- 15-29 days before departure: 80% of total tour cost
- Less than 15 days before departure: 100% of total tour cost (no refund)
Cancellations must be submitted in writing to [email protected].
7.2 Cancellation by Company
We reserve the right to cancel tours due to:
- Insufficient participant numbers (minimum group size not met)
- Force Majeure events
- Safety concerns or government travel advisories
- Operational requirements
In such cases, we will offer alternative dates, different tour options, or full refund of payments made. We are not liable for any additional costs incurred by clients.
8. Changes to Bookings
Requests to modify confirmed bookings are subject to:
- Availability of requested changes
- Administrative fee of MYR 200 per change
- Any difference in tour pricing
- Approval by service providers
Changes requested within 30 days of departure may not be possible and will be treated as cancellations subject to applicable fees.
9. Travel Documentation and Requirements
9.1 Passports and Visas
Clients are responsible for:
- Valid passport with minimum 6 months validity from return date
- Obtaining appropriate visas and entry permits
- Meeting all entry requirements for Cambodia
- Costs associated with travel documentation
9.2 Health Requirements
Clients must:
- Ensure they are medically fit to participate
- Obtain recommended vaccinations
- Disclose relevant medical conditions affecting participation
- Carry necessary medications and prescriptions
10. Travel Insurance
We strongly recommend comprehensive travel insurance covering:
- Trip cancellation and interruption
- Medical expenses and emergency evacuation
- Lost, damaged, or delayed baggage
- Personal liability
tropicirkan is not liable for costs arising from events covered by adequate travel insurance.
11. Client Responsibilities
Clients agree to:
- Arrive at designated meeting points on time
- Follow guide instructions and safety protocols
- Respect local customs, laws, and temple regulations
- Dress appropriately for temple sites (covered shoulders and knees)
- Behave respectfully toward guides, other participants, and local communities
- Not engage in illegal activities or prohibited photography
- Take responsibility for personal belongings
12. Liability and Disclaimers
12.1 Service Provision
Our services are provided "as is" to the best of our ability. While we make every effort to ensure quality experiences, we do not guarantee:
- Specific weather conditions or visibility at sites
- Absence of crowds at temple locations
- Availability of specific accommodations or transport
- Uninterrupted access to all scheduled sites
12.2 Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the total amount paid for services
- We are not liable for indirect, consequential, or incidental damages
- We are not responsible for actions of third-party service providers
- We are not liable for personal injury, illness, or property loss except where caused by our negligence
12.3 Force Majeure
We are not liable for failure to perform obligations due to Force Majeure events including natural disasters, political instability, health emergencies, or other circumstances beyond reasonable control.
13. Intellectual Property
All content on our website, including text, graphics, logos, images, and tour itineraries, is the property of tropicirkan and protected by intellectual property laws.
You may not:
- Reproduce, distribute, or modify our content without written permission
- Use our content for commercial purposes
- Remove copyright or proprietary notices
14. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to such collection and use as described therein.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the Malaysian courts.
15.2 Complaint Procedure
If you have concerns about our services:
- Raise issues with your guide or tour manager immediately
- If unresolved, submit written complaint to [email protected] within 30 days of tour completion
- We will investigate and respond within 30 days
15.3 Alternative Dispute Resolution
Before pursuing legal action, parties agree to attempt resolution through good faith negotiations or mediation.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and tropicirkan regarding our services, superseding any prior agreements or understandings.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of modified Terms.
Bookings confirmed before changes will be governed by the Terms in effect at the time of booking.
